EOR Services in Mexico: Frequently Asked Questions

What is an Employer of Record (EOR)?

An Employer of Record (EOR) is a company that helps you hire employees in another country, such as Mexico, without the need to establish your own entity there.

The EOR acts as the legal employer on your behalf, handling hiring and ensuring compliance with all labor obligations, taxes, and social security requirements.

It takes care of the legal and administrative aspects of employment, while you remain responsible for managing the employees’ day-to-day work.

How much does it cost to hire an employee in Mexico?

Total employment cost is approximately 40% above gross salary. On top of that, the EOR charges a service fee, either a percentage or a fixed amount per period.

Can we hire both remote and on-site positions?

Yes. EOR covers both work models anywhere in Mexico, with no restrictions on location or work arrangement.

Can we hire contractors or only employees?

Yes! Independent contractors can also be engaged through a Contractor of Record (COR) model.

How long does onboarding take?

In most cases, employees and contractors can be onboarded within hours once compensation, job details, and required documentation are confirmed.

What benefits are mandatory in Mexico?

Employees in Mexico are entitled to 12 days of paid vacation after completing their first year of service, a 25% vacation premium, and at least 15 days of year-end bonus (Aguinaldo) each year.

Can we pay commissions, bonuses, and reimbursements?

Yes. All of them can be processed periodically or per event, in addition to the regular payroll.

What happens when an employee is terminated?

Voluntary resignations require only the payment of accrued benefits. Unjustified terminations require mandatory severance as defined by Mexican law

Is EOR legal in Mexico?

Yes. Employer of Record services are legal in Mexico when they comply with local labor, tax and social security regulations.

Why use an EOR instead of opening a local entity?

Setting up a company in Mexico takes time, capital, and ongoing administrative overhead. An EOR lets you hire immediately, with full compliance and none of the operational burden.

Does an EOR support visa or relocation processes?

As EOR we can hire workers who already hold a valid work visa and, in some cases, act as the sponsor for a new visa application.
